The short version
Your proposal or agreement with us sets out the exact scope, price and timeline of your project.
We work hard for results, but no honest agency can guarantee specific rankings, traffic or sales.
Once you have paid in full, the work we create for you is yours.
About these terms
These terms apply to everyone who visits nextfume.com and to every client who engages NextFume, a digital marketing agency based in Howrah, West Bengal, India. “NextFume”, “we”, “us” and “our” refer to NextFume. “You” and “client” refer to the person or business using our website or services.
If a signed proposal, statement of work or service agreement with you says something different from these terms, that document takes priority for your project.
Using our website
You may use our website to learn about our services and contact us. When you do, you agree not to:
Use the website for any unlawful or fraudulent purpose
Attempt to gain unauthorised access to the website, its server or any connected system
Introduce viruses, malicious code or anything that could harm the website
Copy, scrape or republish our content, designs or case studies without written permission
We work to keep the information on our website accurate and up to date, but it is provided for general information only and may change without notice. It is not professional advice for your specific situation.
Our services and proposals
We provide SEO, local SEO, AI search optimisation, paid advertising management, and website design and development. Before any project begins, we send you a proposal that sets out the scope, deliverables, timeline and fees.
A project starts once you have accepted the proposal in writing (email is fine) and paid any advance listed in it. Work requested outside the agreed scope is quoted and agreed separately before we start it.
Your responsibilities
Good results depend on teamwork. To help us deliver, you agree to:
Give us timely access to the accounts, websites and information we need
Review and approve work, content and campaigns within a reasonable time
Make sure everything you provide, including text, images, logos and product claims, is accurate and that you have the right to use it
Make sure your products, services and advertising comply with the laws that apply to your business
Keep your own backups of your website and data
Delays in access, feedback or approvals may delay timelines and results. We are not responsible for delays caused by them.
Fees and payment
Fees, payment schedules and currency are set out in your proposal or invoice
Monthly retainers are billed in advance at the start of each month
Invoices are due within 7 days unless your proposal says otherwise
GST and any other applicable taxes are charged in addition to our fees where required
Advertising spend is paid by you directly to the platform (for example Google or Meta) and is separate from our management fee
If a payment is overdue, we may pause work until it is received
Fees already paid are non-refundable for work that has been carried out
Results and no guarantees
Search engines and advertising platforms control their own algorithms, auctions and policies, and change them often. For that reason, we do not guarantee any specific ranking, position, traffic level, number of leads, sales or return on ad spend.
What we do promise is honest advice, proven methods, transparent reporting and consistent work towards the goals we agree with you. Results in our case studies reflect those clients’ circumstances and are not a promise of the same results for your business.
Third-party platforms and tools
Our work often relies on third-party platforms such as Google Search, Google Ads, Google Business Profile, Meta, YouTube, LinkedIn, Shopify and WordPress. Your use of those platforms is governed by their own terms. We are not responsible for their outages, policy decisions, account suspensions or changes to how they work, although we will always help you respond to them.
Ownership of work
Once you have paid in full, you own the final deliverables we create specifically for you, such as website designs, content and ad creatives
Ad accounts, analytics properties and Business Profiles we set up for you belong to you, and we will hand over full access when our work ends
We keep ownership of our own tools, templates, processes and know-how, which we may continue to use in our work
Content on nextfume.com, including text, graphics, logos and case studies, belongs to NextFume and may not be reused without our written permission
Confidentiality
We keep your business information, account access and data confidential, and use it only to deliver your project. We ask you to do the same with our proposals, pricing and methods. This duty continues after our work together ends. How we handle personal information is explained in our Privacy Policy.
Case studies and portfolio
We are proud of our work and may mention your business name or show the work we have done for you in our portfolio. We will only publish a detailed case study with performance data with your permission, and you can ask us to remove any reference to your business at any time.
Ending an engagement
Either of us can end an ongoing engagement with 30 days’ written notice, unless your proposal sets a different minimum term
Either of us can end it immediately if the other seriously breaches these terms and does not fix the breach within 14 days of being asked
When an engagement ends, you pay for work completed up to the end date, and we hand over your deliverables and account access
Limitation of liability
We take great care with our work, but to the fullest extent the law allows:
We are not liable for indirect or consequential losses, such as lost profits, revenue, data or business opportunities
We are not liable for losses caused by third-party platforms, algorithm updates or circumstances outside our reasonable control
Our total liability for any claim relating to a project is limited to the fees you paid us for that project in the three months before the claim arose
Nothing in these terms limits liability that cannot be limited by law.
Indemnity
You agree to compensate NextFume for any claims, losses or costs arising from content, materials or instructions you provide, or from your products, services or advertising breaking any law or third-party rights.
Changes to these terms
We may update these terms from time to time. The latest version will always be on this page, with the date it was last updated at the top. Changes do not affect projects already agreed under an earlier version, unless we both agree in writing.
Questions about these terms
If anything in these terms is unclear, we are happy to explain it before you start working with us.
